12 month term agreement

Notice of Dues Renewal: If this Membership Agreement (this “Agreement”) has
monthly dues payments,the monthly dues will renew automatically on a monthto-month basis at the end of the initial term referred to on the right, with dues
paid in an amount equal to the original dues adjusted upward to reflect any price
increases as they may occur. This Agreement may be cancelled at any time after
the original term by giving 30-day written notice prior to the monthly dues date
delivered to Proof Fitness or by sending by certified mail, return receipt requested to
Proof Fitness, 230 West Main St. Lexington, KY 40507. Member Initials: ______
Member affirms, acknowledges and attests that Member’s mailing address,
telephone number, cellular telephone number and e-mail address provided on the
face of this agreement are accurate and were provided by Member voluntarily.
Subject to applicable law, Member agrees that Proof Fitness and ABC Financial
Services, LLC, including its agents and affiliates, may contact Member at any mailing
address, telephone number, cellular telephone number or e-mail address set forth
on the face of this agreement, or subsequently provided by Member to Proof Fitness
and/or ABC Financial Services, LLC.
Notwithstanding any other provisions of this Agreement, you understand and agree
that the amount of your monthly membership dues is based on current sales tax
rates and to the extent such rates should increase during your membership, the
club has the right to increase your monthly membership dues by the amount of
such increase. If you have requested the privilege of paying your monthly dues
by pre-authorized electronic funds transfer, the monthly amount so transferred
will be adjusted to reflect any increase in the sales tax rate

ANNUAL FEE:  Ninety (90) days after the membership start date, and each year thereafter, each Member will be required to pay a $39.00 Annual Fee (plus sales tax if applicable) to provide for programs, equipment, classes, facility upgrades and maintenance.  This fee will be charged to you via the billing method indicated in this Agreement, which may be changed or updated from time to time.

MEMBER'S RIGHT TO CANCEL
IF WITHIN THREE (3) BUSINESS DAYS OF THE DATE OF THIS AGREEMENT YOU DECIDE YOU DO NOT WISH TO REMAIN A MEMBER, YOU MAY CANCEL BY MAKING OR DELIVERING WRITTEN NOTICE TO PROOF FITNESS.  THE NOTICE MUST SAY YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT AND MUST BE DELIVERED OR MAILED BEVORE MIDNIGHT OF THE THIRD BUSINESS DAY AFTER YOU SIGN THIS AGREEMENT.  THIS NOTICE MUST BE DELIVERED OR MAILED BY CERTIFIED MAIL, RETURN RECEIPT REQUESTED, ADDRESSED TO PROOF FITNESS AT THE ADDRESS SET FORTH AT THE BEGINNING OF THIS AGREEMENT, TO THE ATTENTION OF THE GENERAL MANAGER.  IF CANCELLED WITHIN THREE BUSINESS DAYS, YOU WILL BE ENTITLED TO A REFUND OF ALL MONEYS PAID.
